What Is a Lasting Power of Attorney?

A Lasting Power of Attorney allows you to appoint one or more trusted people — known as attorneys — to make certain decisions on your behalf.

You create the LPA while you have the required mental capacity to do so.

LPA Registration Matters

Creating the documents is not the end of the process. An LPA must be registered with the Office of the Public Guardian before it can be used.

A Property & Financial Affairs LPA may, depending on the instructions within it, potentially be used after registration while the donor still has capacity.

A Health & Welfare LPA is used for relevant decisions when the donor lacks capacity to make the particular decision themselves.

Do Not Leave It Until It Is Needed An LPA needs to be created while the donor has sufficient mental capacity to make it. If capacity has already been lost, an LPA cannot simply be created retrospectively by the family.
