Evans Legacy Planning provides Lasting Power of Attorney support for individuals, couples and families in Cardiff and surrounding South Wales.
We help you understand the two types of LPA, choose suitable attorneys and put clear instructions in place before they are ever needed.
A Lasting Power of Attorney allows you to appoint one or more trusted people — known as attorneys — to make certain decisions on your behalf.
You create the LPA while you have the required mental capacity to do so.
Putting an LPA in place in advance can make it significantly clearer who should be able to help if illness, injury or loss of capacity affects your ability to deal with important matters yourself.
Official GOV.UK LPA guidance →They cover different areas of your life. Many people choose to consider both.
This LPA deals with financial and property matters.
This LPA deals with certain personal welfare and healthcare decisions.

Nobody likes imagining a time when they may struggle to make important decisions themselves.
But putting an LPA in place while everything is well gives you the opportunity to decide who you would trust and how you would like them to act.
That can give both you and your family much greater clarity if difficult circumstances ever arise.
Being a spouse, partner, child or close relative does not automatically provide legal authority to deal with every financial or welfare matter.
Family members may not automatically be able to access or manage another person's accounts.
Selling, managing or dealing with property can require the correct legal authority.
Important financial decisions may become much more difficult without advance authority.
Family members do not automatically have unrestricted authority over another adult's welfare decisions.
Where somebody lacks capacity and no suitable authority exists, a Court of Protection application may need to be considered in some circumstances.
Trying to resolve authority after capacity has already been lost can create additional work, uncertainty and delay.
Your attorneys can potentially deal with extremely important parts of your life, so the decision should not be made simply because somebody is the closest family member.
Think about trust, reliability, practical ability, relationships between attorneys and whether the person understands the responsibility involved.
You can also consider how multiple attorneys should make decisions and whether replacement attorneys should be appointed.
Tick anything that applies to you. This is designed to identify useful planning questions rather than provide legal advice.

We help make a technical process easier to understand step by step.
Discuss your circumstances and what you want your LPAs to achieve.
Identify suitable attorneys and possible replacements.
Prepare the Property & Financial Affairs and/or Health & Welfare arrangements.
Follow the required signing, witnessing and certificate process.
The LPA must be registered with the Office of the Public Guardian before use.
Homeowners, landlords, investors and business owners often have additional financial responsibilities that could become difficult to manage if they were suddenly unable to deal with matters themselves.
An LPA should therefore be considered alongside your wider estate planning rather than treated as an isolated form.
Creating the documents is not the end of the process. An LPA must be registered with the Office of the Public Guardian before it can be used.
A Property & Financial Affairs LPA may, depending on the instructions within it, potentially be used after registration while the donor still has capacity.
A Health & Welfare LPA is used for relevant decisions when the donor lacks capacity to make the particular decision themselves.
